Four Factors to Look for When Hiring a Real Estate Lawyer

When you are buying or selling a home without a real estate agent, it is recommended that you hire a real estate lawyer to review the contract and paperwork. The attorney can ensure all of the paperwork is legally binding and that there are no loopholes that would cause problems for either party down the road.

Since buying or selling a home yourself is not something the average person frequently does, odds are that you have never hired a real estate lawyer before. Here are four of the factors you should pay attention to as you go about hiring one for your real estate transaction.

1. What Their Similar Case Experience Is

One of the first factors that you want to consider when you are hiring a real estate lawyer is what their history is with cases similar to yours and what experience level they have with them.

Asking the attorney how long they have been handling real estate law in your local area and how many clients they have had with transactions or cases similar to yours will help you determine what their experience level is. Finding an attorney who has experience with the local area, as well as cases similar to yours, helps to ensure they are familiar with local laws and ordinances that may come into play, which is extremely important.

2. Who in the Office Handles Your Case

Another key factor to consider when you are looking to hire a real estate lawyer is who in the office would be helping you with your case. The attorney you sit down with and talk to is not always the attorney who will be helping you with your real estate transaction.

In some offices, a paralegal can help to fill out your real estate forms. In other offices, the attorney who has the lightest caseload may look over your documents. You always want to know who you are hiring and who you will be working with, so always consider this factor before selecting a real estate attorney.

3. What and How You Are Charged

Any time you are hiring an attorney, it is always important to ask how an attorney calculates their fees and about how much they estimate the transaction or case will cost you.

Some real estate lawyers will charge you by the hour. Other real estate lawyers will charge one flat fee to complete a transaction. There are pros and cons to both attorneys who charge by the hour and those who charge a flat fee. Research these pros and cons to find out which is the better option for you, and then find a real estate attorney who charges in a way that you feel is most beneficial to you.

4. What Services They Provide

The last factor that you need to look for when you are hiring a real estate lawyer is what services the law firm completes on your behalf. For example, if you are hiring a real estate lawyer to help you close on your new home, you need to know what services they offer to help you complete this task. Do they help you write up the offer? Do they only review the contract between you and the seller? Will they conduct a title search on your behalf?

Each and every real estate law firm provides different services. Some may provide you with fewer services, and some may provide you with more services. Always make sure that you know what services they are going to complete on your behalf and ensure that the services best meet your needs.
